Génesis Ester Gutiérrez Castellanos was born in Austin, Texas, goes to kindergarten there, and is—by law—a US citizen. None of that mattered when ICE agents picked her up on January 11 and deported her alongside her mother, Karen Gutiérrez Castellanos, to Honduras, a country Génesis had never known. The deportation was tied to an old administrative order against her mother, not the child, but ICE took both—no hearing, no judge, no meaningful legal access.
“I kept telling them ‘the girl was born here’. They didn’t care, they picked up the child, just put a jumper on her and told me to get into the car with her,” Gutiérrez said. Mother and daughter were held for nearly a week in a hotel, effectively disappearing from the system, while lawyers were unable to locate them. Immigration experts say this tactic is becoming more common—and more dangerous for due process.
The mother’s case is especially grim. Gutiérrez fled Honduras in 2018, later surviving domestic abuse and applying for a U visa—a protection specifically designed for victims of violent crime. Her application was still pending due to massive backlogs, yet that didn’t stop ICE from moving fast once local police flagged an “active ICE warrant” during a domestic disturbance call in Austin.
Now back in Honduras, Gutiérrez says she plans to send her daughter alone back to the US to live with relatives—because that’s where her life, school, and future are. “The day I separate from my daughter will be the most painful of my life but I will do it for her future.” It’s a choice no parent should be forced to make, yet one analysts say will become more common as deportations accelerate under Donald Trump’s renewed immigration crackdown.
This is not an isolated case. Immigration advocates warn that US citizen children are increasingly being caught in the dragnet as ICE enforcement expands, even as courts block attempts to end birthright citizenship. The message is clear: legality matters less than logistics, and citizenship is no longer the shield parents were told it was.
