Judge Orders Release of Tufts Student Detained by ICE in Retaliation for Free Speech

A Vermont judge has ruled that Tufts University student Rumeysa Ozturk must be released from ICE custody, marking a significant victory for free speech advocates.

The judge determined that the government's evidence was insufficient to justify her detention, which was linked to a pro-Palestinian opinion piece Ozturk co-wrote for her student newspaper. The ruling follows similar actions taken by the Trump administration to silence foreign-born student activists, particularly those linked to pro-Palestinian protests. Ozturk, who suffers from asthma, was held in overcrowded conditions that exacerbated her health issues, with several asthma attacks documented.

In his ruling, Judge William Sessions emphasized that Ozturk's continued detention threatened to chill the First Amendment rights of many non-citizens in the U.S., noting that "Her continued detention potentially chills the speech of the millions and millions of people in this country who are not citizens."

Ozturk, who is a Ph.D. student, was detained in Louisiana, far from her legal team and academic institution, leading to widespread criticism.

The release of Ozturk comes just days after a federal appeals court upheld a similar ruling in favor of Columbia University student Mohsen Mahdawi. The case reflects an ongoing crackdown on campus activism, particularly aimed at students with ties to pro-Palestinian movements.
