Trump’s D.C. Power Grab Just Hit the Gas Pedal

Bowser tells Bondi to pound sand as the feds try to bulldoze the city’s laws and police leadership.

If you want a preview of what “law and order” means in Trump’s second term, look no further than Washington, D.C. Spoiler alert: it’s less “keeping the peace” and more “federal hostile takeover with a side of ICE checkpoints.”

This week, Mayor Muriel Bowser and D.C.’s Attorney General Brian Schwalb drew their line in the sand—hard—after U.S. Attorney General Pam Bondi issued an order that would effectively strip the city of control over its own police department. Bondi tried to install DEA chief Terry Cole as “emergency police commissioner,” give him full MPD authority, and shred the city’s sanctuary policies.

Bowser and Schwalb’s response? Nope. Not happening.

This standoff didn’t come out of nowhere. On Monday, Trump signed an executive order declaring a “crime emergency” in a city with the lowest violent crime rate in 30 years. He then appointed Cole to run the police and flooded D.C. streets with federal agents and National Guard troops.

The legal pretext comes from the 1973 Home Rule Act, which—while it gives D.C. an elected government—also lets the president commandeer the police “for federal purposes” in an emergency. The problem? No one has ever tested this in modern times, so the law is a big gray area.

And what EXACTLY is the emergency? Sounds like D.C. is managing its crime well enough that it’s at a 30-year low!

Bondi decided to “clarify” who’s in charge by firing off orders Thursday night—orders that included not just the new federal police commissioner but also tearing up policies that limit cooperation with Immigration and Customs Enforcement. In a city that prides itself on being a sanctuary jurisdiction, that’s like spraying kerosene on a political bonfire.

MPD Chief Pamela Smith, perhaps trying to walk a tightrope, had just issued her own order expanding cooperation with ICE in some areas—like sharing information on people stopped but not arrested. That move alone infuriated several council members. Then Bondi swooped in, torched Smith’s order, and gutted D.C.’s existing limits on ICE cooperation entirely.

If you’re thinking, “This sounds like a recipe for fascism,” you’re right. Residents are already protesting federal checkpoints, and local lawmakers are calling Bondi’s decree an “unlawful power grab” and a “break-the-glass moment for our democracy.” Smith, who just days earlier was talking on Fox 5 about how the federal surge might be “positive,” is now stuck in a political no-man’s land where neither side is happy.

And here’s the kicker: Trump has been explicit about the broader goal. “This city will no longer be a sanctuary for illegal alien criminals,” he said Monday. “We will have full, seamless, integrated cooperation at all levels of law enforcement.” That’s not just rhetoric—it’s a direct challenge to the city’s Sanctuary Values Amendment Act of 2020, a law House Republicans already tried to repeal earlier this year. Bondi’s order is basically a shortcut to doing it without the Senate’s help.

The deeper implication? If this move stands, the precedent is dangerous. The federal government could essentially nullify local laws in D.C.—and by extension, flex similar muscle over other jurisdictions under the guise of “emergency” policing. Once that genie’s out of the bottle, it’s not going back in, no matter who’s in the White House.

D.C.’s leadership is bracing for a legal fight that could end up as the definitive court test of the Home Rule Act’s limits. In the meantime, the city’s law enforcement is caught between two bosses: The one they’ve always had and the one Trump just appointed. Neither side is backing down.

The only certainty? This is going to get uglier before it gets resolved.
